Terms and Conditions
Please read these Terms and Conditions (“Terms”) carefully before engaging with ANW Developers LLC (“we,” “our,” or “us”). These Terms apply to all agreements, services, and interactions with our company, whether verbal, written, or electronic. By using our services, signing a contract, or otherwise doing business with us, you agree to these Terms.
Services
We provide construction, renovation, project management, and related development services as agreed upon in a formal project proposal, estimate, or signed contract.
All services will be delivered in a professional manner in accordance with industry standards and applicable laws.
Quotations and Estimates
All quotes or estimates are valid for [30] days from the date issued unless otherwise stated.
- Any changes to the scope of work may result in additional charges.
- Unexpected site conditions, material changes, or design revisions may lead to cost adjustments.
- Final pricing will be confirmed through a signed agreement or approved change order.
Payment Terms
Unless otherwise agreed in writing, our standard payment terms are:
- [30]% deposit upon contract signing
- [40]% progress payment(s) based on project milestones
- [30]% final payment upon completion or handover
Payments are due within [7-14] days of invoice. Late payments may incur interest charges at [1.5%] per month or the maximum allowed by law.
Client Responsibilities
Clients agree to:
- Provide access to the property/site as needed
- Obtain all necessary permissions (e.g., HOA, landlord)
- Cooperate with inspections and approvals when required
- Respond to decisions or requests in a timely manner
Delays caused by the client may result in adjusted timelines or costs.
Project Timeline
We will make reasonable efforts to meet the agreed project timeline. However, delays may occur due to weather, material shortages, permit approvals, labor availability, or other unforeseen events.
We are not liable for delays outside our control, but we will communicate any changes promptly.
Warranties
We provide a [12-month] workmanship warranty from the date of project completion. This warranty does not cover:
- Normal wear and tear
- Damage due to misuse, neglect, or third-party alterations
- Materials or products covered by manufacturer warranties
Claims must be submitted in writing during the warranty period.
Liability
To the maximum extent permitted by law:
- We are not liable for indirect, incidental, or consequential damages
- Our total liability for any claim related to our services is limited to the amount paid by the client for the specific service or project
Clients are responsible for maintaining appropriate property and liability insurance.
Termination
Either party may terminate a contract or agreement with [14 days’] written notice, subject to:
- Payment for all work completed to date
- Reimbursement of any committed or non-refundable expenses
- Return of company-owned equipment or materials
In cases of breach of contract, we reserve the right to terminate immediately.
Intellectual Property
All project designs, plans, drawings, and documentation remain the property of ANW Developers LLC unless otherwise agreed in writing. Clients may not reproduce or reuse them without permission.
Governing Law
These Terms are governed by the laws of New Jersey, without regard to conflict of law principles. Any disputes will be resolved in the courts of New Jersey.
Modifications
We reserve the right to modify these Terms at any time. Updates will be posted on our website or sent to clients directly. Continued use of our services after changes constitutes acceptance.
